Ohio EPA Reaches Settlement with YSD Industries
COLUMBUS, Ohio -- The Ohio Environmental Protection Agency has reached a settlement with YSD Industries Inc. for violating air pollution control regulations at its manufacturing and fabricating business located at 3710 Hendricks Road, Austintown. The company agreed to pay a $10,000 civil penalty. YSD Industries manufactures railcar doors and sides and fabricates material-handling equipment. The operation includes cleaning and coating equipment and a paint dip tank to coat railroad car parts. The operations emit volatile organic compounds and hazardous air pollutants, which are defined in Ohio law as air contaminant sources.Ohio law also requires new air contaminant sources to obtain a permit-to-install. The operation also generates more than 10 tons per year of hazardous air pollutants, requiring the company to apply for a Title V operating permit within 12 months. In December 2000, an emissions unit was built without obtaining a permit-to-install. In January 2001, a warning letter was sent by Ohio EPA advising the facility of the requirement to obtain an installation permit. In February 2001, an application was submitted, and a permit was issued allowing 61.3 tons per year of VOC emissions. This, combined with existing emissions, brought the facility into Title V status. The facility was cited for: Installing a new air contaminant source without a permitOperating a major source without applying for and obtaining Title V authorizationFailing to submit reports and fees required by Ohio law for 2001. The company then went under foreclosure by its lender, and in March, the facility submitted an offer to Ohio EPA to settle pending enforcement actions to complete a foreclosure sale. The $10,000 civil penalty will be paid to Ohio EPA. As provided by State law, the penalty will be split evenly between the Ohio Environmental Education Fund and air pollution control programs. "
