Ohio AG Sues Platinum Warranty Corp.
COLUMBUS, Ohio -- State Attorney General Jim Petro yesterday filed suit in Cuyahoga County on behalf of consumers against the Platinum Warranty Corp., alleging that the company did not honor its automotive warranties.Consumers in Ohio and in various states have filed over 140 complaints against the Platinum Warranty, located on Rockside Road in Cleveland. The complaints state Platinum sold motor vehicle warranties and failed to deliver all of the contracted services or refund the consumers' money. Petro alleges these are direct violations of the Failure to Deliver Rule, and therefore considered unfair and deceptive acts and practices in violation of the Ohio Consumer Sales Practices Act.Further allegations also state violations of the federal Magnuson-Moss Warranty Act for failing to honor warranties sold.The federal Magnuson-Moss Act applies to written warranties for consumer goods costing more than $10. The act does not require businesses to offer written warranties; however, any written warranty must be written, clear and understandable.Petro is asking the court to prevent Platinum Warranty from committing further violations. He is also asking for consumer restitution and civil penalties of $25,000 per violation.Consumers who have purchased a warranty through Platinum and believe that their claim was not properly handled may file a complaint with the Attorney General's Consumer Protection Section online (www.ag.state.oh.us)."
