YOUNGSTOWN, Ohio -- Ice Zone co-owner Bruce Zoldan today filed a complaint in Mahoning County Common Pleas Court alleging Thomas Hutch Jr., his business partner in the Boardman skating rink, owes him more than $800,000 in damages.
The lawsuit was filed Wednesday, one day after PNC Bank filed a foreclosure complaint in U.S. District Court for the Northern District of Ohio against the Ice Zone Ltd., Zoldan and Hutch, alleging that the business is in default of a $2.8 million promissory note (READ STORY).
According to the lawsuit, Zoldan says he paid obligations of the Ice Zone totaling $1,365,814 on the note to National City Bank, now PNC Bank, between 2004 and 2007. Hutch, court papers say, "has paid none of the obligations of the Ice Zone entities," and "has refused to pay such contribution" to the plaintiff.
Documents allege that Hutch owes Zoldan $682,907 on the note, or 50% of what Zoldan paid, another $10,177 on a promissory note executed between the parties, $16,546 on a promissory note of $50,000, and deed to property at the Ice Zone site or monetary damages of $97,709.
Together, the damages add up to $807,339, records show.
Zoldan is president and CEO of B.J. Alan Co. and co-owner of the Youngstown Phantoms Hockey Team, which practices at the Ice Zone and plays its games at the Covelli Centre in downtown Youngstown.
Hutch is the president of the Aerolite Extrusion Co. in Youngstown.
Hutch could not be reached for comment.
